The main gallery is
in our 1898 building one block South of the courthouse.
Auctions are also held in St. Charles Place, two blocks
east of
the main gallery.

Our Gallery is smoke free, pet free, and children free.
The following as amended by any posted notices or oral
announcements during the sale, constitutes the entire terms and
conditions on which property shall be offered for sale or sold
through the Ant Street Gallery ("the Gallery"), for any consignor of
such property for whom we act as agent, and for property owned by
the Gallery. Different Terms and Conditions apply to live online
auctions as posted therein.
As used herein the term "bid price" means the price at which a
lot is knocked down to the purchaser and the term "purchase price"
means the aggregate of (a) the bid price (b) a premium of a
percentage of the bid price payable by the purchaser to the Gallery
if applicable, and (c) unless the purchaser is exempt by law from
the payment thereof, any state or local sales taxes. On the fall of
the auctioneer's hammer, the highest bidder shall be deemed to have
purchased the offered lot in accordance with all of the conditions
set forth herein and thereupon (a) assumes full risk and
responsibility therefore (b) if requested will sign a confirmation
of purchase thereof, and (c) will pay the purchase price in full.
The Ant Street Gallery charges a
buyer's premium to be added to the hammer price on each lot purchased.
The premium is equal to 12% of the hammer price on those lots sold in
the Gallery and sold through the online catalog at
www.antstreetgallery.com.The
buyer's premium may be higher in Ebay Live Auctions. Texas purchasers
pay an additional 8.25% sales tax unless exemption form is on file with
the Gallery.
The Gallery reserves the right to withdraw any lot at any time
before the actual sale.
The Gallery reserves the right to reject a bid from any bidder.
The highest bidder acknowledged by the auctioneer shall be the
purchaser. In the event of any dispute between bidders, or in the
event the auctioneer doubts the validity of any bid, the auctioneer
shall have sole and final discretion either to determine the
successful bidder or to re-offer and resell the lot in dispute. If
any dispute arises after the sale, the Gallery's sales records shall
be conclusive in all respects. In the event of a tie bid between an
absentee bidder and a live bidder, the lot will be sold to the live
bidder present in the Gallery.
While many items in the auction will be sold without reserve, if
a lot is offered subject to a reserve (the confidential minimum
price below which the lot will not be sold), the Gallery may
implement such reserve by bidding on behalf of the consignor or
owner, whether by opening bidding or continuing bidding until the
reserve is obtained, by placing consecutive bids, or bids in
response to other bidders. Consignors shall not be permitted to bid
on their own items.
While the Gallery has endeavored to catalog and describe the lots
correctly, each lot is sold "AS IS", and neither the Gallery nor the
seller warrants or represents, nor shall be responsible for, the
description, value, genuineness, dimensions, authorship, provenance,
importance, or condition of a lot. Any such statements are opinion
and not to be taken as fact. No statement contained in the
catalog or made verbally prior to or during the sale shall be deemed
to express any warranty, representation, or assumption of
responsibility by the Gallery or the seller.
In the event that the buyer of any lot fails to pay the purchase
price thereof when due, the Gallery shall have the option, at its
sole discretion, to (a) enforce payment by civil action or other
proceedings against the buyer; (b) to void the sale as if said sale
had not occurred; or (c) to exercise any other remedy or remedies
available under the law, including but not limited to a second sale
of said item, including the subsequent enforcement of any deficiency
against the initial buyer.
The Gallery reserves the right to require that advance bids
received either by mail or by means of telecommunications including
E-mail
be accompanied by a 25% deposit. The Gallery shall not be held
responsible for bids that are missed or otherwise not executed. The Gallery further reserves
the right to require payment in full of the purchase price at the moment of successful bid. The purchase price must be
paid by the successful bidder in cash, on or prior to the close of
the auction. Checks are acceptable if the buyer is accredited with
the Gallery. Wire transfer may be required for purchases over
$3000.00.
Absolutely no items may be removed prior to payment in full. All
items must be removed by the purchaser thereof promptly after the
auction. A minimum handling charge of $25.00 plus storage charge of
$5.00 per day will be assessed against any items remaining in the
custody of the Gallery by the close of business of the tenth day
following the auction. At any time after 30 days past the auction
date the Gallery may resell on hand property subject to its usual
commissions and charges.
All items handled or stored will be at the purchasers risk.
Storage charges must be paid before merchandise is released.
Descriptions of works of art are
defined as follows:
Signed- the work of the artist in the opinion of the Gallery
Attributed to- Probably the work of the artist
Circle of- Work of the artist's period and style
Manner of- Work in the artist's style but probably later
After- A later copy of the artist's work
Paintings are often dimensioned by
outer frame dimensions to facilitate shipping estimates. Visible canvas
dimensions will be listed as "Sight".
